Terms of Service

The terms that govern your use of SoulMindCare’s services.

Last updated: 7 July 2026 · This document is a working draft prepared for review by a qualified legal professional before the website goes live.

1. Agreement to These Terms

These Terms of Service govern your use of the SoulMindCare website (soulmindcare.com) and our online therapy and counselling services. By using our website or booking our services, you agree to these terms. SoulMindCare is operated from Tripunithura, Kerala, India, and founded by Ms. Minna Mathew (M.Phil Clinical Psychology, RCI Registered).

2. Our Services

SoulMindCare provides online psychological therapy, counselling, assessments, and related services delivered by qualified psychologists via secure video sessions. Services are available to clients in India and internationally, subject to professional and legal limitations that your therapist will discuss where relevant.

3. Not an Emergency Service

SoulMindCare is not a crisis or emergency service. If you or someone you know is at immediate risk of harm, or experiencing a medical or psychiatric emergency, do not use this website to seek help — contact your local emergency number or go to the nearest hospital immediately. In India, you can also contact a recognised suicide-prevention helpline such as Tele-MANAS (14416).

4. No Doctor–Patient Relationship via Website Content

Content on this website — including blog articles, condition pages, and service descriptions — is provided for general information and education. It is not a substitute for professional diagnosis, advice, or treatment, and reading it does not create a therapist–client relationship. A professional relationship is established only when you formally engage our services.

5. Booking, Free Consultation, and Fees

The initial consultation offered through our website is free of charge and carries no obligation. Fees, scheduling, cancellation, and rescheduling policies for ongoing therapy will be communicated clearly before you commit to paid sessions. [PLACEHOLDER — insert final fee schedule, payment methods, and cancellation notice period once pricing is finalised.]

6. Client Responsibilities

You agree to provide accurate information when booking and during therapy; to attend sessions from a private, safe location with a stable internet connection; to use the services for yourself (or a minor for whom you are the lawful guardian); and not to record sessions without the express agreement of your therapist.

7. Confidentiality and Its Limits

Therapy is confidential, subject to narrow exceptions required by law and professional ethics — for example, where there is serious risk of harm to you or another person, or where disclosure is legally mandated. These limits will be explained to you before therapy begins. See our Privacy Policy for how we handle your data.

8. Services for Minors

Therapy for children and adolescents is provided only with the informed consent and appropriate involvement of a parent or legal guardian.

9. Technology Requirements

Online sessions require a device with camera and microphone and a reliable internet connection. Where a session fails for technical reasons, we will make reasonable efforts to reconnect or reschedule without penalty.

10. Intellectual Property

All website content — text, design, graphics, and branding — is the property of SoulMindCare and may not be reproduced or used commercially without our written permission. You may share links to our content freely.

11. Third-Party Links and Services

Our website may link to third-party websites or services (for example, WhatsApp for contact, or external services such as career counselling partners). We are not responsible for the content or practices of third-party sites.

12. Limitation of Liability

To the maximum extent permitted by law, SoulMindCare shall not be liable for indirect or consequential losses arising from use of the website. Nothing in these terms limits liability that cannot lawfully be limited, and nothing affects the professional duty of care owed to you within an established therapeutic relationship. [PLACEHOLDER — lawyer to review and localise limitation and indemnity language.]

13. Suspension or Refusal of Service

We may decline or discontinue services where they are clinically inappropriate, where a client’s needs exceed what online therapy can safely provide, or where these terms are materially breached. Where we cannot serve you, we will endeavour to suggest appropriate alternatives or referrals.

14. Governing Law and Jurisdiction

These terms are governed by the laws of India, and disputes shall be subject to the exclusive jurisdiction of the courts at Ernakulam, Kerala. [PLACEHOLDER — lawyer to confirm jurisdiction clause and any consumer-law carve-outs for international clients.]

15. Changes to These Terms

We may update these terms from time to time. Continued use of the website or services after changes take effect constitutes acceptance of the updated terms.
